Rights

As an Article 17 worker, you have the right to:

  • a contract with a notice period
  • pay under the same conditions as the other employees in the same category
  • paid holidays (if they fall within your contract)
  • reimbursement of travel and expenses: under the same rules as for other employees. Be careful, though! These amounts count towards the calculation of your annual maximum amount.
  • other benefits such as meal vouchers: as for the other employees. Be careful! Here too, these amounts count towards the calculation of your annual maximum amount.
  • the organisation’s employment regulations
  • occupational accident insurance
  • well-being at work

However, you are not entitled to

  • guaranteed pay in the event of illness or accident
  • training

Contract

Make sure you have a contract between yourself and the organisation before you start work. Before you sign the contract, check the number of hours you have left in artikel17@work. You can always keep an eye on your number of hours using this counter!

The employers are the ones who enter your working hours, but you can check your hours at any time.

Working hours

You can work flexibly, e.g. in the evening, on Sundays and/or on public holidays, for a maximum of 11 hours per day and a maximum of 50 hours per week.

You will receive 20% extra pay for ‘flexitime hours’: for the time you work between 9 hours and 11 hours per day, between 40 and 50 hours per week and the hours on a public holiday.

Young people under 18 years of age are allowed to work a maximum of 8 hours per day and a maximum of 40 hours per week.

Notice

The notice period is:

· 14 (calendar) days:

    • for a permanent contract if you have worked for less than 6 months
    • for a temporary contract of less than 6 months

· One month:

    • for a permanent contract if you have worked for more than 6 months
    • for a temporary contract of more than 6 months

Tax form

At the end of each year, a tax form 281.27 is submitted for the calculation of your taxes.
